Careless Driving

A Careless Driving charge covers a wide variety of situations, whether an accident has occurred, but it is most frequently given to drivers involved in a collision. The Highway Traffic Act of Ontario defines it as “driving a vehicle or streetcar on a highway without due care and attention or without reasonable consideration for other persons using the highway.”

This is a serious charge, but one that is open to interpretation. Legal representation is crucial when fighting a Careless Driving traffic ticket.

Penalties Include:

  • Six (6) Demerit Points
  • A fine of $500 up to $2,000
  • 30 –Day licence suspension (6 months to 2-year suspension in serious cases)
  • Substantial increase in car insurance premiums
  • Possible imprisonment up to 6 months (in serious cases)

At Traffic Court Advocates, we will obtain and examine the police accident report and all evidence and thoroughly review your case. We investigate every legal argument to eliminate or reduce the charge, decrease the fine, and negotiate your demerit points. We are dedicated towards maintaining your driving record.
