Careless Driving

A Careless Driving charge covers a wide variety of situations, whether or not an accident has occurred, but it is most frequently given to drivers involved in a collision. The Highway Traffic Act of Ontario defines it as “driving a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway.”

This is a serious charge, but one that is open to interpretation. Legal representation is crucial when fighting a Careless Driving traffic ticket.

Penalties Include:

  • Six (6) Demerit Points
  • A fine of $500 up to $2,000
  • 30 –Day licence suspension (6 months to 2-year suspension in serious cases)
  • Insurance increase of 100% for 3 to 6 years
  • Possible imprisonment up to 6 months (in serious cases)
